Philadelphia Pennsylvania DAI / DUI Defense Attorneys
In February 2004, a new Pennsylvania drunk driving law went into effect that took a tiered approach to drunk driving offenses. There are three tiers of drunk driving charges (called driving after imbibing, or DAI, in Pennsylvania):
-
General Impairment: .08 to .09 blood alcohol content (BAC)
-
High BAC: .10 to .159 blood alcohol content
-
Highest BAC: .16 or more
The penalties increase as your blood alcohol content increases. They increase even further if you are a commercial driver, a minor, or were involved in an accident that caused injuries or property damage while driving drunk. If you refuse a breath or chemical test when asked by the police, you will face the highest level of penalties.
Drunk Driving Penalties
The penalties for driving while intoxicated include fines, a revoked license, community service, driving school, jail time, and even prison, depending upon your history of drunk driving offenses.
Most people end up pleading guilty because the case against them is solid, but in the experience of Philadelphia DUI defense attorneys John E. Kusturiss, Jr. and Alyssa K. Poole, it always pays to do a thorough investigation before accepting a plea and penalties. Your license and lifestyle — maybe even your livelihood — depend upon it.
Challenge Breathalyzer Tests
DUI defense attorneys John Kusturiss and Alyssa Poole have had cases dismissed because a thorough investigation showed that the only evidence against the client — the breathalyzer — was calibrated incorrectly or gave an inaccurate result. They are prepared to challenge the accuracy of tests.
